Dear Mr. Owner/Operator:
As you may be aware, all facility Tier II filings for the
2000 calendar year are due to the LEPC by March 1, 2001. This year all reports
are to be filed electronically and submitted on a 3” disk, using the Tier 2 WIN
3.0 (Windows) reporting software. If you did not use this program for filing
last year, it is available to be downloaded from the US Environmental
Protection Agency Chemical Emergency Preparedness website: http://www.epa.gov/swercepp/tier2.htm.
Instructions on downloading and using the program are included. Copies of the
Tier II forms and instructions are also available on the website.
Retail gasoline stations with inventories in underground
storage tanks of less than 75,000 gallons at any one time, that are in
compliance with state and federal UST requirements are no longer required to
file annual Tier II reports with the LEPC or SERC. Initial reports are required
when a gasoline station is first opened and updates are required when the
emergency contacts or other pertinent information for the retail gasoline
station are changed. This change only applies to retail gasoline stations,
facilities that store gasoline and other fuels for their own vehicles or other
use are still required to submit annual Tier II Reports. Additional information is available from the

Tier II Report filings may be made by mailing the disk along
with a signed letter of certification to the Framingham Local Emergency
Planning Committee c/o Framingham Fire Department, 10 Loring Drive, Framingham,
MA 01702. When filing electronically,
the signed cover letter of certification shall be mailed to the LEPC at the
above address. Copies of the filing must also be submitted to the Mass State
Emergency Response Commission, PO Box 1496, Framingham, MA 01701-0317.
The letter of certification shall state:
"I certify under penalty of law that I have personally
examined and am familiar with the information submitted on the Tier II Form
dated ____ for [Name of Facility], and that based on my inquiry of those
individuals responsible for obtaining the information, I believe that the
submitted information is true, accurate, and complete."
The signed Letter of Certification fulfills the legal
requirement for the signature of the facility owner/operator or
owner/operator's authorized representative.
